Terms of Use

In order to use the services offered on the UNIWHERE platform, you have to agree to these terms of use. With registration, your consent is considered granted. Please read the terms of use carefully.

1. Parties

  1. The provider of the UNIWHERE platform is Develhope S.R.L, Via Siracusa 16, 90143 - Palermo, Italy, P.IVA: IT06803120820, [email protected] (hereinafter: UNIWHERE) .
  2. These terms of use apply only to students who are at least 18 years old and enrolled at a university, provided that the university has provided them with login data for the use of the university network (hereinafter: user). A contract for the use the UNIWHERE platform is created exclusively between UNIWHERE and the user.
  3. For products and services of third parties that are offered or brokered via the UNIWHERE platform, separate agreements with these third parties may have to be concluded. In this case, a contract is concluded exclusively with third parties and the user, but not with UNIWHERE, unless it is because something else has been expressly agreed.

2. Scope

  1. UNIWHERE offers various services on the online platform uniwhere.com (hereinafter: UNIWHERE services), which can be accessed using the app for iOS and Android (hereinafter: UNIWHERE platform).
  2. Conflicting or different terms and conditions of the user do not become part of the contract. This also applies if UNIWHERE does not expressly contradict the terms and conditions of the user.

3. Registration and conclusion of contract

  1. All users must register in order to be able to use the UNIWHERE platform (hereinafter: registration). As soon as a user has logged on to the UNIWHERE platform with the login data provided by the university, the registration is considered complete .
  2. The user assures that the information provided during registration is complete and correct. In the event of incorrect or incomplete information, UNIWHERE is entitled to block the user account immediately. Should the user data entered during registration change later , the user must inform UNIWHERE immediately.
  3. The completed registration represents the offer of the user to conclude the contract. UNIWHERE reserves the right to verify the identity of the user by means of a corresponding procedure. With the activation of the user account, UNIWHERE accepts the offer of the user.

4. Cancellation policy

  1. The UNIWHERE platform is made available to users free of charge. Revocation instructions are therefore not required (Section 312 (1) BGB).

5. UNIWHERE services

  1. The UNIWHERE service enables the user to directly and automatically access, via his mobile device, the information about his university career that is available on the portal of his university, if this application supports it. The aforementioned data is in accordance with the applicable legislation on the processing of personal data.
  2. The first time the application is accessed, a personal UNIWHERE user profile is created, through which the user can view his university data, comments and possibly other data such as photos, videos, links that are visible to other users (hereinafter Content called), according to the development of the application characteristics
  3. Subject to a separate consent in each case, the user can activate additional functions. The main functions of the UNIWHERE service are summarized below:

6. UNIWHERE Premium

Subscription

  1. Some parts of the Service are billed on a subscription basis (Subscription(s)). You will be billed in advance on a recurring and periodic basis (Billing Cycle). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
  2. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or UNIWHERE cancels it. You may cancel your Subscription renewal either through your your Store Profile Page by contacting UNIWHERE customer support team.

Free Trial

  1. UNIWHERE. may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (Free Trial).
    You may be required to enter your billing information in order to sign up for the Free Trial.
  2. At any time and without notice, UNIWHERE reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

7. User obligations, exemption obligation

  1. The user must provide the following hardware and software for using the UNIWHERE platform and meet the technical requirements: The technical requirement is an internet-enabled mobile device with the operating system iOS from version 9 or Android from version 4.0.3.
    Procurement, installation, maintenance and operation of all necessary software and hardware are the sole responsibility of the user. UNIWHERE is in no way responsible or liable for the user’s Internet access, including but not limited to any connection speed, bandwidth or latency issues that could affect the user’s access to, or use of, the UNIWHERE platform.
  2. The user is obliged to keep the login information (user name, password) strictly secret at all times and to ensure that no unauthorized persons have access to the UNIWHERE platform. There are indications that the login information is from an unauthorized person are used, UNIWHERE is entitled to block the user account until the matter has been clarified.
  3. The user undertakes not to post any illegal content on the UNIWHERE platform or to make it accessible to third parties. In the event of violations, UNIWHERE is entitled to immediately block the user account of the user The user is not entitled to copy, modify, adapt, reproduce, translate, distribute, pass on, reconstruct, decompile or disassemble the contents and other features of the UNIWHERE platform. The user must not impair the functionality of the UNIWHERE platform and its connection to users, hosts or networks in any way, in particular not by viruses, overload, flooding, spamming, mail bombing or crashing or other computer codes, files or programs that are suitable are to interrupt, destroy or restrict the functionality of the computer software or hardware or the telecommunications equipment.
  4. The user may not violate the copyrights and other property rights of third parties via the UNIWHERE platform.
  5. The user will indemnify UNIWHERE from all claims of third parties based on a violation of this regulation, and will defend UNIWHERE against it. The user will also reimburse UNIWHERE all costs in connection with the claim of a third party. This also applies to reasonable costs of legal defense.

8. Rights of use and data protection

  1. All rights to the UNIWHERE platform remain the property of UNIWHERE. UNIWHERE grants the user a non-exclusive and non-transferable right to use the UNIWHERE platform for the duration of this agreement as intended and in accordance with these terms of use.
  2. If the user posts his own copyrighted content such as news, photos or reviews on the UNIWHERE platform, he grants UNIWHERE the non-exclusive, transferable, sublicensable, fee-free, unlimited time and space right to provide this content of the respective service on the UNIWHERE platform to the extent necessary for this purpose. The right of public access ends when the user removes the content from the UNIWHERE platform.]
  3. The user expressly declares his consent to the processing of his personal data by UNIWHERE in accordance with a separate data protection declaration. This becomes part of the contractual relationship between the user and UNIWHERE. UNIWHERE can only collect, save and use the user’s data with the consent of the user .

9. Liability and warranty

  1. UNIWHERE is only liable for damages in the event of intent and gross negligence. In the event of simple negligence, UNIWHERE is only liable for damage to life, limb or health, for damage in accordance with the Product Liability Act or for damage from the violation of an essential contractual obligation (obligation , the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner regularly trusts and can trust); in this case, however, UNIWHERE’s liability is limited to the replacement of the foreseeable, typically occurring damage.
